What Is A Debt Verification Letter?

If you are receiving hassling calls from collection agencies, you need to know that you are guaranteed by law to certain rights and protections.  One of these protections is the right to debt verification letter to be sent to your home in order for the collection agency to continue to seek payment from you.  This letter clearly outlines the origin of the debt, when the debt was created, information about the collection agency (such as address and phone number), and why the collection agency is contacting you.  If you ask for a debt verification letter, the collection agency must provide it to you via mail within 30 days.  Without providing this letter, the agency is no longer allowed to contact you concerning the debt.



Where Can I Find A Debt Verification Letter?

First, let’s clarify that there are two letters we will be discussing.

The first letter is the letter than you send to the collection agency.  This letter does not need to be complicated.  You simply put in writing that you are requesting verification of the debt the collection agency is contacting you about and that you would like a debt verification letter to be sent to your home. When you are contacted by a collection agency, advise the person that you will be requesting a debt verification letter and ask for the address of the collection agency.  At this point, you should cease communication with the collection agency until you have received their response letter.

The second letter is the letter that the collection agency must send back to you via mail within thirty days.  The required contents of this letter are provided above.  Without providing you with this letter, the collection agency has no legal right to continue to pursue you for payment.
