Debt Consolidation Facts

1. If you spend more than 50% of your credit limit every month, this indicates to the Credit Bureau that you do NOT have enough cash on hand to meet your monthly expenses. This will identify you as a high credit risk and will actually reduce your credit score by 60 - 70 points overnight (Fair Isaac).

2. If you miss 1 or 2 payments on your credit card debt, the issuing company will skyrocket your interest rate to a whopping 27% - 30%!

3. Out of a random sample of 3 million American consumers (included in Experian's National Score Index), 51% of them have at least 2 credit cards and 14% of them have 10 or more credit cards.

Stop 3rd Party Debt Collection Calls

Debt Collections will often call 3rd parties when trying to locate a debtor. They are allowed to do this legally only if they do NOT already have the debtor's location and whereabouts information (physical address & phone number). Debt collectors who know the debtor's physical address & phone number but still decide to make 3rd party collection calls are violating the Section 804(3) law of the Fair Debt Collection Practices Act (FDCPA).

We therefore provide you with a sample of this Stop 3rd Party Debt Collection Calls letter. Click here to get an MS Word format version of this letter. A .doc file will open up and save it to your Desktop. This way you can easily retrieve the file.

Mr/Mrs. Debt Collector,

This letter is to inform YOU that you are violating the Fair Debt Collection Practices Act (FDCPA) by calling me constantly regarding 3rd party debt collection. Specifically, you are violating the following clauses:

804(3) - Acquisition of Location Information (15 USC 1692b): Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information.

806(5) - Harassment or Abuse (15 USC 1692d): A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. The following conduct is a violation of this section; "Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number."

I have already told you on many different occasions that the debtor you are trying to locate does NOT live at my physical address, is not associated with my phone number, has no relationship with me and that I can not provide you his/her location information. Thus, I demand that you stop calling me regarding this 3rd party debt collection immediately. You are NOT allowed to call my at my home, work, or any other location under Section 804(3).

If I receive 1 more debt collection call from your company, be informed that I will be tape recording it and will consider this action a violation of my rights under the Fair Debt Collection Practices Act. I will not hesitate to pursue any legal action to stop you from harassing me or my family.
